O texto traz novidades importantes em rela\u00e7\u00e3o ao que vigora hoje. Em primeiro lugar n\u00e3o \u00e9 mais obrigat\u00f3ria a contrata\u00e7\u00e3o do provedor de acesso nas conex\u00f5es do Servi\u00e7o de Comunica\u00e7\u00e3o Multim\u00eddia (SCM). O conselheiro Marcelo Bechara, contudo, manteve intacta a Norma 4, apesar de haver uma recomenda\u00e7\u00e3o expressa do Minicom para a ag\u00eancia revisar a norma.<\/p>\n<p>Segundo Bechara, trata-se de um &#8220;mero ajuste na defini\u00e7\u00e3o do servi\u00e7o&#8221;. &#8220;Com o advento da banda larga, o pr\u00f3prio prestador do SCM pode fazer algumas atividades que s\u00e3o feitas exclusivamente pelos provedores no caso da conex\u00e3o discada&#8221;, explica ele.<\/p>\n<p>A Norma 4, que basicamente separa o servi\u00e7o de telecomunica\u00e7\u00f5es do servi\u00e7o de valor adicionado, fica mantida, mas \u00e9 ineg\u00e1vel que o novo regulamento do SCM permite que a operadora de conex\u00e3o fa\u00e7a a autentica\u00e7\u00e3o para o acesso \u00e0 Internet.<\/p>\n<p>De qualquer forma, a quest\u00e3o n\u00e3o foi enfrentada a fundo porque h\u00e1 conex\u00f5es discadas que necessitam do provedor para se conectarem \u00e0 rede. Em 2011, quando a Anatel come\u00e7ou a tratar do assunto sob relatoria da conselheira Em\u00edlia Ribeiro, cerca de 10% das conex\u00f5es eram discadas. Evidentemente esse percentual hoje \u00e9 muito menor. Al\u00e9m disso, Bechara sustenta que a possibilidade de conex\u00e3o \u00e0 Internet pela pr\u00f3pria prestadora do SCM n\u00e3o impede a manuten\u00e7\u00e3o de atividades exclusivamente prestadas pelo provedor de acesso \u00e0 Internet.<\/p>\n<p>O novo regulamento traz novos valores para as outorgas do servi\u00e7o. A outorga do SCM custar\u00e1 R$ 400. Pelo pre\u00e7o antigo de R$ 9 mil, o empres\u00e1rio agora leva a outorga de SCM, STFC (telefonia fixa) e SeAC (TV por assinatura). Ou por R$ 9 mil a empresa j\u00e1 outorgada do SCM poder\u00e1 adicionar as outras outorgas, de TV e de telefonia fixa.<\/p>\n<p><strong>Neutralidade e guarda de logs<\/strong><\/p>\n<p>A proposta do conselheiro Marcelo Bechara era de simplesmente retirar a men\u00e7\u00e3o \u00e0 neutralidade de rede, tendo em vista que o assunto est\u00e1 sendo discutido pelo Congresso Nacional. O conselheiro Rodrigo Zerbone, entretanto, argumentou que seria adequado que a Anatel n\u00e3o deixasse essa chance de tocar no assunto, j\u00e1 que o entendimento \u00e9 de que inevitavelmente a neutralidade de rede compete \u00e0 ag\u00eancia, que regula justamente as redes de telecom. O texto sobre o assunto ficou sint\u00e9tico: &#8220;As prestadoras devem respeitar a neutralidade conforme a legisla\u00e7\u00e3o&#8221;.<\/p>\n<p>Em rela\u00e7\u00e3o \u00e0 guarda de logs, que tamb\u00e9m \u00e9 tratada pelo Marco Civil da Internet, o entendimento n\u00e3o foi de que deveria se esperar a defini\u00e7\u00e3o do Congresso. O novo regulamento determina que as empresas de SCM devem guardar os registros pelo prazo de um ano. &#8220;Aqui \u00e9 o lado negro da Internet. N\u00e3o podemos ser complacentes e deixar que as autoridades n\u00e3o tenham instrumento e deixar que aqueles que cometem crimes fiquem acobertados pela falta de regulamenta\u00e7\u00e3o&#8221;, diz ele.<\/p>\n<p>Fonte: (teletime)<\/p>\n<p style=\"color: #000000;
